How can I change my daughter's last name to my new husbands last name ?

Her bi-logical has never been in her life and and my new husband has been since day one.

How can I change my daughter's last name to my new husbands last name ?
I think your husband has to legally adopt her in order for that to happen. you can go to your county court house and ask about the process. If you do not know who her biological father is or she doesn't have his last name then it might be easier.

you might need a lawyer and stuff. your husband might have to go before a judge and testify that he wants to give her his last name and become her legal father. contact a family services attorney that specialises in this sort of thing and good luck
Reply:You have to do a legal name change...which when it involves a minor is a huge pain. I allowed my son to use the man who has raised him last name..I had no problems at school. To change it legally now I had to find his father and get consent..like you that was not possible. So we used it through school and when he turn 18 he is changing it himself.
Reply:i think if you have him officially adopt her then you can change it from her biological father's name to your husband's name.
Reply:if you have full custody it shouldnt be a problem just go to the registrar especially if you now have your husbands last name.i think it depends on if she actually has his last name and if he gave up his rights.your husband can addopt her but only after your ex signs his rights away.is your ex on the birth certificate?if not then he has no parental responsibility anyway legaly
Reply:If he's the adoptive father, you should be able to change her name through state agencies. You can find forms for it by looking at your states web site. If her biological father is the last name she carries, you may have to get his permission or have your husband adopt her, formally.
Reply:Your hubby has to adopt your daughter.
Reply:how old is she?
Reply:i think he has to adopt the child. get an attorney
Reply:You need to get permission from your ex or have proof that he signed his rights away. Contact a lawyer to find out exactly what the law says in your state, but that's how it works here. Good luck.
Reply:Usually your daughter needs to be adopted by your husband. Her biological father (I believe) needs to terminate his parental rights. I'd check with a lawyer if I were you and check with your county. Good luck.
Reply:He has to legally adopt her and then you have to present it to the judge that he has legally adopted her and request permission to change her last name (if the adoption procedure didn't do that already).

Reply:The process is just like changing your name when you get married. You have to do it legally. I would think he would want to adopt her so got for the whole cake and icing also. You will have to go through the courts.

I changed my daughters last name from her sperm donor to my last name.
Reply:i think you have to get permission from the judge im really sorry that her father was never thier for her i just hope that things get better for you guys
