Can a mother after giving birth give her child the fathers last name even if not present?

The father may be doing time in jail. How does someone go about doing this?


In the state of Arizona.


And PLEASE no comments about well he shouldnt be in jail.. Everyone makes mistakes, in this case just doing what he's gotta do.

yes. the mother fills out the birth certificate. You can choose to put your last name or the father's. Your full name and his full name are also put on the certificate my you (the mother).
Reply:In some states the father has to sign unless the couple is married I live in Tn and here if you are married the guy you are married too goes on there even if he is not the father however if you are not married the guy has to be there to sign the paper stating that he is the father. The hospital should be able to help you or you could call your local health dept. if you cant put his name on there they should have some form you can have him fill out later to change the birth cert.
Reply:If you mean when your child is born then you can choose whatever name. If you want to change it then you have to go to court and Im sure they won't ask if your changing it to his last name. They will probably just ask for a consent form that says that the father agrees with it.
Reply:Yes. You can name the baby anything you want. The name doesn't determine who the father is. The baby doesn't even have to have your last name or the father's.


The father can sign paternity papers saying he claims to be the father no matter what the last name is.
Reply:You can give the baby any last name you want. The fathers name won't be added to the birthcertificate but you can still give the baby his last name if you want.
Reply:Yes you can. You can call your child whatever you want to
