How do I change my daughters last name to mine. There is no father in picture or on birthcertificate?

I put a friend's last name on the birth certificate, but that person is no longer a friend, and not the father of my baby.

Oh, my gosh ya'll lay off the girl. She didn't ask if you thought giving her daughter a diff last name was a mistake. She asked how to fix it.


It should be relatively easy. Go down to the courthouse ask them how you should go about it, because every state is different. They should just give you some paperwork. Luckily for you no one is listed on the birthcertificate. If you do have to go to court. It'll be for like 15min. The judge will ask why your changing her name and give you permission. Then you'll have to amend the birth certificate and file for a new ss card.


When in doubt contact a lawyer, but they always give you instructions to go along with that kind of paperwork if you ask.

Reply:this was a mistake...I'm not tryin to be mean but now you have to go to a courthouse or city county building(something like that) and put a a request for a name change,then pay the fee because you will be charged a fee to do this,then you will have to get a new birth certificate and social security card with the new name on it.Its kinda like getting married only no husband or wife.Also I am not definate on this but I think the friend might have to be there as well because they would have had to sign an affidavit in order for baby to get their last name.
Reply:Hey... well most likely it depends on the state you are in... and the age of the child. For instance I had changed my daughters last name back to my maiden name, but I had to do an amendment form for like $40 before her 1st birthday. Its free you are just paying for the certificate. You can name the child whatever you want but if you listed your ex-friend as the father, then its harder, you will more than likely have to go to court with him o have the name removed and changed and pay all types of court fees. It could take a while. But if your child is still an infant and that person is not listed as the father the line is blank for father then its just a matter of going to your court house library and getting the paperwork and mailing it off with your payment to your states General Attorney's office and waiting a few weeks. I believe that for a name change within a few days, you can do it for free, but I'm not sure if that's even true, or what the period of time is.





My mom had her name changed when she was 16, and had to go through the courts and pay a fee. She also had to get her birth certificate amended, which was another, additional fee. It's free (I think) to get a new social security card, as long as you have a valid reason (like a name change, not like you lost it).





My son's name was misspelled on the hospital paperwork, but luckily, I caught it before his information was sent out. So the birth certificate ended up being right, but when his social security card arrived his name was misspelled again, in a different way than the hospital misspelled it. His name is Eian Micheal, and the hospital first spelled it Ian Michael, and then on the SSC it was Elan Michael. For that change, I had to get a certified copy of his birth certificate (with the proper name on it, so you'll need to start by changing your daughters BC), go into the social security office, fill out one simple form, and then turn everything in. They made a copy of his BC, took the misspelled SSC, and then his new, correct one arrived about 3 weeks later.





I was married last summer, and changed my last name. It was a hassle, but I had the marriage license as proof of the change for the BMV and the SS office. You will need some sort of legal document as well.





I would call either the clerk of courts and see if they can't give you an idea of what paperwork to file, or call a family lawyer. Usually, breif consultations are free.

Reply:In south africa if you're not married the time of birth the mother has automatic custody over her children. I was in the same boat as you except my sons father's name was on the birth certificate. He wasn't supporting his son or me and when i wanted to change my sons surname back to my surname at first they wanted the fathers permission. when they found out we weren't married they assisted me in the change of surname. so my advise: if you stated you were married you'll have to get the friends permission somehow to change the surname. but seeing as you aren't friends anymore why dont you just ask him to sign full custody over to you then you'll be able to change his surname without his consent. if you weren't married at the time of birth and you stated so on the birth registration forms you can just go in to your home affairs dept. and do the change. Hope this helps. As it would in south africa. Not to sure what your laws are in your country.

Why would you put a "Friend" on your childs birth cert?


Not exactly the smartest thing in the world, now is it?





You'll have to go through a lengthy and costly process to get your childs name changed to yours. It also requires a court order, so unless you can get a court order (not easy), you are stuck with someone elses last name on your child.
Reply:First of all you made a very big mistake by putting your so call friend put his name on her Birth Certificate, but now yes you do have to go to court %26amp; see what you can do %26amp; get done that's the only way around it all if you can prove he or she's yours.
