What happens if i dont put the fathers last name on my childs birth certificate?

can he get it put on there by proving he is the father? i wont get child support? how does that work?

If you鈥檙e married the father鈥檚 name automatically goes on the birth certificate because he is the legal father. If you aren鈥檛 married, then *you* cannot list a father on the birth certificate without his consent. Both you and him would have to sign an affidavit of paternity/acknowledgement of paternity/whatever its call in your state. Once his name is listed on the birth certificate he is then the legal father.





If his name is listed on the birth certificate then you simply petition for child support. If his name is not listed on the birth certificate, then paternity has to be established first (the court will order a dna test) before child support can be ordered. Once paternity has been established, the court normally orders that the birth certificate be amended to list Dad as the father.





If your question is rather or not the child has to have his last name鈥?


In most states (probably all states), if Dad is listed on the birth certificate, the child is automatically given his last name unless *both* Mom and Dad agree otherwise (some states require they sign a form to this effect). If Dad鈥檚 name is not on the birth certificate, you can give the child any last name that you like--your last name, Dad鈥檚 last name (you don鈥檛 need his permission), or any other. The child does not have to have Dad鈥檚 last name in order for you to receive child support. However, once paternity is established Dad can ask the court to give the child his last name. They may agree to that (I鈥檝e seen it happen), but more than likely, they will order that the child鈥檚 last name be hyphenated.
Reply:the hospital requires the first and last name if know (in North Carolina) .Child support has nothing to do with it when you go to the court if he contest they will do a paternity test but the birth certificate has nothing to do with it
Reply:he doesn't have to sign it.but to get child support you will have to prove paternity.that can be ordered by the court.please do that,so we don't have to pay for it.
Reply:First, he can sue you to establish that he is the father by means of a paternity test. Thereafter, his name would be added to the birth certificate as your child's father.





Second, once identified as the father, you can sue him for appropriate child support.

Reply:No matter if you place his name on there or not and want to get support; any dad can ask for a paternatity test to prove he is the father. If he wants it put there he can have it added to it. All up to him there. You can get c.s. if he does agree he is the dad unless otherwise, no matter if he is on there or not. Best to get tested so he can't squirm his way out.
Reply:You allow him to skate on child support if you don't identify him coming out of the gate.
Reply:No, you don't have to use fathers last name. Yes, you will still receive child support.





Can't see why he would fight it, if he doesn't want anything to do with fatherhood.





If he thinks he wants to fight the "last name" issue, don't forget you have that same right. However, I'm not certain about that.





Call Legal Aid (won't cost) and ask about that part.
