How do I give my child his fathers last name when the father is incarcerated?
In the state I live in you can't put the father's name on the birth certificate if he was unable to sign the certificate, but , interestingly enough, you can give the child a last name that you made up whether its the parents last name or not.





You need to contact an attorney t find out what the rules are for your state.
Reply:Try looking up child support agency for your county and give them a call. They can either contact the prosecuting attorney for you or will provide you with the contact info . In the past few years states have really been cracking down on getting father's names on birth certificates. Report Abuse

Reply:Just because the child's father is in jail doesn't mean that he doesn't deserve to have his child carry his name on..there are alot of men wrongly incarcerated ... their still fathers who deserve their name carried on.. mr. big
Reply:you can give your child whatever last name you want to without the father being present. he just won't be able to sign the birth certificate until he gets out.
